Arba apie bylų eiles ir pinigų trūkumą teismuose
Vakar eilinį kartą teko pabendrauti su teisėjais. Šįkart kartu nuėjome pas Premjerą. Nors bėdos aiškios (trūksta pinigų), džiaugiuosi vienu - visiems tampa aišku, kad bėdos sprendžiamos ne tik ieškant pinigų, bet (visų svarbiausia!) pritaikant sprendimus, kurie leistų pasiekti daugiau teisingumo greičiau ir pigiau. Ne kartą viešumoje teko šnekėti apie tai, tad ką tai reiškia konkrečiai, kokius konkrečiai tikslus keliu 2010 metams.
Pirma, e-ieškinys. Ieškinį turi būti galima pateikti elektroniniu būdu. Įsivaizduoju, kad tuo ypač turėtų naudotis įmonės, keliančios daug ieškinių. Toks e-ieškinys sutaupytų laiko ir lėšų tiek bylos šalims, tiek teismams.
Antra, elektroninės procedūros priimant teismo įsakymą. Paprastos, arba taip vadinamos mokėjimų bylos, kai yra aiški paslaugų sutartis, bet nėra už jas atsiskaityta (ir abu faktai patikrintini pasinaudojant IT sistemomis) turėtų būti sprendžiamos teismo įsakymu, kurio projektas turi būti generuojamas automatiškai. Tai reikštų, kad bene pusę visų dabartinių civilinių bylų galėtų spręsti vienas teisėjas viename teisme kur nors Molėtuose, Šilalėje ar kur kitur. Tik vėliau iškilus ginčui vienas kitas procentėlis šių bylų keliautų į ginčo teiseną.
Trečia, beprasmių ginčų ir leidimų skaičiaus sumažinimas. Teisėjas turi būti atlaisvintas nuo beprasmių darbų. Pavyzdžiui, atlyginimo antstoliams priteisimas bent jau tose ribose, kokios yra būtinosios antstolio išlaidos vykdant sprendimą. Arba skyrybų bylos, kai buvę sutuoktiniai nei turi nepilnamečių vaikų, nei ginčijasi dėl santuokos nutraukimo pasekmių (šiuo atveju jau geriau privalomas mediavimas ar privalomas laikotarpis apsigalvoti).
Ketvirta, teismo pranešimo siuntimų ir kito susirašinėjimo supaprastinimas ir elektronizavimas. Pranešimų neįteikimas šiandien yra viena opiausių problemų, o prezumpcija, kad pranešimas įteiktas, kai apie jį paskelbta spaudoje yra tiesiog neteisinga, nekalbant apie šio metodo brangumą. Elektroniniai pranešimų įteikimo būdai ar kitoks pasinaudojimas duomenų sistemomis (pavyzdžiui, prisijungus prie e-valdžios ar kokio kito portalo bet kokiu kitu reikalu, tvarkant reikalus valstybės ar savivaldybės įstaigoje) gali šiuo atveju daug padėti.
Penkta, realus arbitražo ir mediavimo paskatinimas. Šiandien paradoksalu, kad teismais nepasitikima, o arbitražu vistiek nesinaudojama. Mano sudaryta darbo grupė jau tuoj turi parengti naują arbitražo reglamentavimą, kuris, tikiuosi, palenvins šį ginčų sprendimo būdą. Mediavimo paskatinimas ir netgi jo privalomumas kai kuriais atvejais taipogi gali būti išeitis.
Šešta, realus paskatinimas beprasmiškai neginčyti administracinių nuobaudų. Konkretaus plano dar neturiu, bet esu įsitikinęs, kad beprasmio teismų krūvio sumažėtų, jei paskirta administracinė bauda būtų kaip taisyklė ne didesnė nei galimos skirti baudos vidurkis, o jos ginčijimas teisme reikštų klausimo sprendimą iš naujo, t.y., ir galimybę, kad bauda bus didesnė.
Septinta, baudžiamajame procese taipogi turi būti prisimintas ekonomiškumo principas. Be kita ko, galiu pasakyti, kad kitos ES valstybės netgi šaiposi iš Centrinės Europos regiono, kuriame visos valstybės pajėgos metamos kartais neproporcingai mažiems pažeidimams tirti. Pavyzdžiui, ir šiandien Lietuvoje patogų, bet vistiek gana brangų Europos arešto orderio mechanizmą mūsų teismai kartais taiko akivaizdžiai nepropocingai mažų nusikaltimų atveju.
Pagaliau norint spręsti finansines teismų problemas būtina efektyviau organizuoti pačius teismus. Todėl ruošiuosi pateikti Teismų įstatymo pakeitimo projektą, pagal kurį vietoje nuo kitų metų numatytų kanclerių visuose teismuose (ir dėl to - beveik 4 mln. papildomų išlaidų) apylinkių teismai būtų apjungti į ekonomiškesnius ir lankstesnius penkis apylinkių teismus su skyriais dabartinių teismų vietose.
Beje, daugeliui šių sprendimų nereikia papildomų finansų, arba jų reikia niekingai mažai palyginus su tuojau pat gaunamu efektu.

Man abejonių kelia iniciatyva dėl administracinių baudų ginčijimo ribojimo.
Asmeniškai aš matau problemą, kad valstybės institucijos, kurias pirmosios instancijos administracinis teismas pripažįsta pažeidus įstatymą, vis tiek skundžia tokį teismo sprendimą vyriausiajam administraciniam teismui. Ne paslaptis, kad asmeniui teistis su valstybe administraciniuose tesimuose yra gerokai sunkiau nei civilinėse bylose. Užtenka vien senateis terminus palyginti. Senaties terminai administracinėje teisenoje yra tokie trumpi, kad labai daug asmenų apskritai nespėja susigaudyti kol supranta jog “šaukštai po pietų” ginti savo teises kurias pažeidė valstybės institucijos. O šios, net ir pirmosios instancijos teismui pripažinus kad pažeidė įstatymą, ir toliau gaišina teismų darbą. Asmeniškai teko susidurti kai valstybės institucija pirmosios instancijos teisme buvo pripažinta ne bet kaip, o grubiai pažeidusi įstatymą. Ir ką gi - skundė toliau. Tad kaip pavadinti tokį ginčijamąsi - prasmingu ar beprasmišku?
Manau kad administracinių bylų iš tikrųjų turėtų būti gerokai daugiau negu yra dabar, nes žmonės dar labai mažai žino apie savo teises ir per mažai žmonių jas gina. Deja, valstybė tam padeda, nustatydama nenormaliai trumpus senaties terminus ir skirtingas ginčų nagrinėjimo procedūras civilinėse ir administracinėse bylose.

Dėl antro. “Paprastos, arba taip vadinamos mokėjimų bylos” 99 proc. atvejų ir taip pradedamos pagal pareiškimą dėl teismo įsakymo išdavimo, ty supaprastinta tvarka. Pasidomėkit, kiek teismo įsakymų įsiteisėja, o kiek nuieina į ginčo teiseną - manau, tikrai ne “vienas kitas procentėlis”. CPK numatytas neva saugiklis, kad šalis be reikalo neitų ginčo teisena, o naudotųsi teismo įsakymo insitutu - CPK 434 str. 4 d. - bylinėjimosi išlaidos priteisiamos nuo ginčijamos sumos. Neus girdėjęs, kad ši norma bent kartą būtų pritaikyta, bet to ji suformuluota nekonkrečiai ir visiškai neatlieka (ir negali atlikti) savo - kaip saugiklio - funkcijos.
Dėl trečio. Kokie ginčai yra beprasmiai ? Paklausti šalies, ar ji kelia ne beprasmišką ginčą ? Teismų leidimų institutą gal ir galima būtų panaikinti kontrolę perkeliant notarams - jų civilinė atsakomybė apdrausta, tai tegu ir kontroliuoja. Atsisakius atlikti notarinį veiksmą (pav. šeimos būsto pirkimą-pardavimą) interesantai galėtų skųstis teismui. Beprasmės bylos dėl atlyginimo antstoliams ? Kai nuteisiami Antstolių rūmų prezidiumo pirmininkas ir Teisingumo ministerijos klerkas ar Lietuvos antstolių garbės teismo pirmininkas (tik įsiklausykit į pavadinimus). Čia gal valstybei tokie ginčai yra beprasmiai, kai ji gali sau leisti antstoliui sumokėti keliolika kartų daugiau, nei antstolis išieško jos naudai. 9 iš 10 antstolių vykdymo išlaidas prisiskaičiuoja pažeisdami teisės aktus, kai kurie netgi nusirašo nuo sąskaitos be jokio teismo, nes blogiausia, kas už tai gali atsitikti - teismas lieps sugrąžinti pinigus. O koks procentas taip nuskalpuotų žmonių apskritai kreipiasi į teismą ? Todėl tas pats antstolis daro vis tuos pačius pažeidimus ir toliau.
Dėl ketvirto. Labai didelė, bet lengvai išsprendižma problema yra su juridiniais asmenimis. Jie turi pareigą teikti duomenis JA registrui, tame tarpe ir apie savo buveinę - nors sanskcijų jokių nenumatyta. Dažnai buveinės registruojamos kokios bobutės bute. Teimo šaukimas aišku neįteikiamas ir prasideda tikrosio buveinės paieškos. Regitrų duomenys laikomi teisingais, kol nenuginčyti įstatymų nustatyta tvarka, tad kodėl už JA aplaidumą JARe nurodant netikrą buveinę, turi vargti kiti. Turėtų būti taip - išsiuntei JARe nurodytu buveinės adresu šaukimą - vadinasi įteikas tinkamai.
Dėl šešto. Dabar gaunas, kad bet kokiu atveju skųsti reikia, nes blogiau nebus, reikalą gali pataisyti pakoreguotas žyminis ir teismų (LVAT) praktiką. Bet svarbesnė problema (netgi konstitucinė) yra tai, kad administraciniame teisme laimėjęs bylą prieš valstybę (jos paregūną) tau nepriteis bylinėjimosi išlaidų. Tiesa, čia LVATo praktikos, o ne Administracinių bylų teisenos įstatymo problema.

Siūlyčiau projektuoti žiniomis grindžiamas informacines sistemas. Juk eilės bylų turi panašių požymių, scenarijų, sprendimų. Jų detali registracija, indeksavimas sudarytų prielaidas išgauti iš tokios duomenų bazės žinias daliniam arba automatizuotam sprendimų priėmimui.

Dėl arbitražų ir mediacijos, manau, esminė problema ta, kad apie juos negirdima. Kažkodėl atrodo, kad advokatai patys nenori ginčio spręsti arbitraže. Manau, kad čia vadinamųjų bylininkų kaltė t.y. neapsimoka išspręsti ginčo operatyviai, nevilkinant proceso ir be jokių apeliacijų ir kacasijų. Kitas dalykas, verslininkai turbūt irgi nežino specifikos, manyčiau, reikėtų juos supažindinti su arbitražo institucija. Užtektų išryškinti akivaizdžius privalumus tokius, kaip konfidencialumas, neformalumas, vos ne visiška dispozicija ar arbitro specialių žinių turėjimas. Tai iš tiesų puiki alternatyvą teisėjams, kurie gyvena įstatymų lygyje ir visiškai nesupranta verslo santykių.
O dėl regalmento keitimo, tai ką ten reikia keisti? Taigi jis copy-paste’intas nuo Niujorko konvencijos ir UNCITRAL taisyklių?

Bene didžiausia problema yra procesinių dokumentų įteikimas asmenims. Geriausias pasiūlymas jei išsiųsta į JA registracijos vietą, tai laikoma įteikta tinkamai. Teisminė praktika bandė eiti šiuo keliu, bet LAT perdėliojo viską kitaip. Manau, jei CPK reikėtų tiesiogiai nustatyti tokią nuostatą ir klausimas išsispręstų. Tada net LAT kažin ar išdrįstų aiškinti normą contra legem.
Kita problema administracinės bylos. Kažkodėl nuo policijos seimas perkėlė nuobaudų skyrimą teismams. Taip apylinkės teismai, kurie turi daugiausiai darbo, jo gavo dar daugiau. O su mūsų ATPK teisingumo nėra ir būti negali.
Manau reikėtų padidinti sumą, kurios bylos laikytinos dėl mažų sumų (CPK 441 str.). Šiuo metu 1000 Lt, bet reikėtų šią kartelę pakelti iki 1000 EUR, t.y. 3500Lt ir šias bylas leisti teismams nagrinėti rašytinio proceso tvarka, suteikiant galimybę asmeniui motyvuotai prašyti nagrinėti žodinio proceso tvarka r teismui leisti savo iniciatyva nuspręsti nagrinėti žodinio proceso tvarka. Dabartine tvarka, žmonės paprastai visada paprašo žodinio ir iš proceso supaprastinimo gaunasi šnipštas.
CPK 232 str. numatyta parengiamojo posėdžio nutartis turi būti išmesta į šiukšlyną, kaip bereikalinga norma. Viskas, ką apkalba parenbgiamajame posėdyje yra užrašoma protokole, po to dar kartą perrašinėti į nutartį ir gaišti laiką yra kvaila. Be to, Konst. Teismas sakė, kad kiekviena nutartis turi būti priimta, parašyta ir paskelbta asmeniui iš karto, kada tai padaryti? Teisėjas ne sau turi susirašyti nutartį, bet šiuo atveju, gaunasi būtent taip.
Dėl leidimų sistemos. Pritariu, kad tai gali spręsti visai kitos institucijos, nelogiška, kad teisėjas turi nuspręsti ar asmuo sugebės padengti kreditą. Absurdas.
Dar reikėtų CPK įvesti tokią tvarką, kad teisėjas kuo daugiau klausimų galėtų spręsti rezoliucija, o ne nutartimi. Laikas tikrai tauposi. Tai neliečia kalusimų dėl kurių gali būti paduodamas skundas.
pritariu Šimašiaus trečiam punktui. Vykdyme turi būti kuo daugiau atsakomybės antstoliui. Dabar visais atvejais antstolio veiksmus turi pertikrinti teismas ir jei bus padaryta negerai, tai žalą atlygins kas? Tas kas tikrino ir priėmė rezoliuciją ar nutartį? Arba pardavimas iš varžytinių. Teismas turi patikrinti (tokia LAT praktika) visą procesą nuo pradžios iki pabaigos ir tvirtinti arba ne. Apsidrausdami teismai dažnai netvirtina dėl mažiausios smulkmenos. todėl nesusikuria parduotų daiktų iš varžytinių rinka. Iš kitos pusės, jei teismas patvirtina, tuomet atsakomybė dėl galimos klaidos kam? Terminai patikrinimui labai maži. Todėl turėtų būti atsakomybė antstoliui, kaip dirbančiam ir teismai imtųsi darbo, jei būtų skundas, bet ne iš anksto.

p.s. dar būtų gerai įvesti žyminį mokestį už laikinųjų apsaugos priemonių taikymą. Teismams sumažėtų bereikalingų prašymų ir klausimų svarstymų, nes dabar reikia nereikia, jų prašo kiekvienas, net kai reikalavimo suma nesiekia 500 Lt. Kartu sumažėtų atskirųjų skundų (šie skundai sudaro labai žymią dalį) ir būtų šiek tiek pinigėlių į biudžetą.

dėl trečio punkto turėčiau pasiūlymą… kasdien teismus pasiekia šimtai pareiškimų dėl teismo įsakymų išdavimo ir 90 procentų pareiškimų yra prašoma taikyti laikinąsias apsaugos priemones (LAP)… Kaip žinome, pareiškimas dėl teismo įsakymo turi būti priimtas ne vėliau, kaip kitą dienąpo jo pateikimo (CPK 435 str. 1 d.) ir įsakymas išduodamas ne vėliau, kaip kitą dieną nuo priėmimo (CPK 436 str. 1 d.)…. taigi- max- 3 dienos… Kas gi nutiktų, jei teismo įsakymo procese netaikytumę LAP? Ogi nieko… paprastai skolos būna uždelstos ne vieną mėnesį, taigi, nei tos 3 dienos, nei 20 dienų, per kurias skolininkas turi sprendimą įvykdyti, nieko nelemtų, o teismui dvigubai sumažėtų darbo su teismo įsakymu (vietoje dviejų dokumentų- nutarties taikyti ar netaikyti LAP ir įsakymo)- užtektų priimti įsakymą, o po to jau kreditorius, jei su juo neatsiskaitoma, galėtų kreiptis į antstolį dėl turto arešto…
